Terms & Conditions

These Terms and Conditions govern your use of opendoors360.com and the photography, 360 virtual tour, and video services provided by OpenDoors360 LLC ("OpenDoors360," "we," "us," or "our"). By booking a shoot or using the site, you agree to these terms.

1. Services

OpenDoors360 provides real estate media services, which may include HDR listing photography, 360 virtual tours, video walkthroughs, aerial and drone coverage (in New York markets), virtual staging, twilight photography, and pre-construction documentation. The exact deliverables, scope, and price for your project are set out in the quote we send you and confirmed when you book.

2. Bookings and quotes

To book, you send the property address, the approximate interior square footage, the services you want, and your listing deadline. We reply with a quote and one or more proposed shoot times. A booking is confirmed when you accept a quote and a scheduled time. Quotes are based on the information you provide; if the property differs materially on site, the scope and price may be adjusted.

3. Pricing and payment

Our standard rates are published on the site and scale with interior square footage. Add-on services are priced as listed or by quote. Payment terms, including any deposit and the due date, are stated on your invoice. Images and other deliverables are licensed to you on delivery and on receipt of payment in full.

4. Turnaround and delivery

Standard delivery is 24 to 48 hours from the shoot, and a rush add-on is available for faster turnaround when our schedule allows. Deliverables are provided through a single download link. Delivery timelines are estimates made in good faith and may be affected by circumstances outside our control.

5. Cancellations and reschedules

Reschedules are free with reasonable notice. We would rather move a shoot than photograph a property that is not ready. Cancellations or reschedules made on short notice, or a failed appointment where we cannot access the property, may be subject to a fee as stated on your invoice or booking confirmation.

6. Image licensing and usage rights

On delivery and full payment, OpenDoors360 grants you a license to use the delivered images, tours, and videos to market the specific property they depict, including on listing services, the MLS, brokerage sites, social media, and print marketing for that listing. Unless we agree otherwise in writing:

• OpenDoors360 retains copyright and ownership of all work it creates.
• The license is for marketing the property photographed and is not transferable to third parties such as builders, stagers, or other vendors without our consent.
• OpenDoors360 may use the work in its own portfolio, website, and marketing, unless you ask us in writing not to and we agree.

7. Your responsibilities

You are responsible for providing access to the property at the scheduled time and for having the property ready to photograph, including staging, cleaning, and removing items you do not want captured. For doorman or managed buildings, you are responsible for arranging access, and we can help coordinate a certificate of insurance and elevator access where needed. We are not responsible for delays or reduced quality caused by a property that is not ready or accessible.

8. Aerial and drone work

Aerial and drone coverage is available in New York markets and is subject to weather, airspace rules, and any required permissions. If conditions or regulations prevent a flight, we will reschedule that portion of the shoot or adjust the scope accordingly.

9. Limitation of liability

We provide our services with reasonable care and skill. To the fullest extent allowed by law, OpenDoors360 is not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to a project is limited to the amount you paid for that project. Nothing in these terms limits liability that cannot be limited by law.

10. Intellectual property

All content on this website, including text, design, and images, is owned by OpenDoors360 LLC or its licensors and is protected by copyright and other laws. You may not copy, reproduce, or reuse site content without our written permission.

11. Third-party platforms and links

We use third-party tools and may link to third-party sites, such as analytics, booking, hosting, and tour-hosting services. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or practices.

12. Governing law

These Terms and Conditions are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any dispute relating to these terms or our services will be handled in the state or federal courts located in Maryland, and you agree to that venue.

13. Changes to these terms

We may update these Terms and Conditions from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the site or our services after a change means you accept the updated terms.
